The Carlton R. Smith Jr. HIV Modernization Act (HB 39) was signed May 20, 2025. Maryland is the 5th state to repeal HIV criminalization. Convictions under the old law have been expunged.

Maryland explicitly authorizes minor consent for PrEP at any age under Md. Code Ann., Health-Gen. § 20-102(c)(9): "Treatment for the prevention of human immunodeficiency virus (HIV)."
